1. General

(1) These General Terms and Conditions (GTC) apply to all offers and services relating to the internet platform www.ernst-kaffee.de. Any reference by the customer to their own terms and conditions is hereby rejected.

(2) Individual contractual agreements take precedence over these General Terms and Conditions.

2. Conclusion of contract

(1) The product descriptions on our website www.ernst-kaffee.de do not constitute a legally binding offer. A binding offer is only made when the customer places an order via the online shop, contact form, telephone, or in text form. The confirmation of receipt of the order does not yet constitute acceptance. The contract is concluded upon receipt of the order confirmation. If the customer uses one of the offered online payment methods, acceptance takes place at the time the payment decision is received by us. If no online payment method is used, the offer expires if we do not accept it within 5 calendar days.

(2) If our acceptance reaches the customer late but was sent in due time, the customer must inform us immediately. Otherwise, acceptance is considered timely. A late acceptance is considered a new offer, which the customer may accept.

3. Applicable law

The contractual relationship is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection regulations of the country of residence remain unaffected.

4. Prices, payment, delivery, shipping costs

(1) Prices include applicable VAT.

(2) Payment methods:

II. International deliveries:

III. Pickup by arrangement is possible at our locations in Cologne against cash payment.

(3) Delivery is made within Germany and internationally after order processing.

(4) Delivery is carried out via UPS, postal service, or freight carrier.

(5) Shipping costs are listed under Shipping Costs.

5. Distance selling information

(1) Product descriptions can be found on www.ernst-kaffee.de.

(2) Information about your right of withdrawal can be found under "Right of Withdrawal".

(3) Delivery takes place within 5 working days after payment confirmation or contract conclusion.

(4) We do not provide additional customer services or warranties.

(5) There is no dispute resolution procedure applicable.

6. Information on electronic commerce

(1) See section 2 for contract conclusion steps.

(2) Contract text storage: customers can save or print the contract text. We also store contracts and provide them upon request.

(3) Corrections: entries can be corrected during checkout or by using browser navigation.

(4) Contract language: German.

(5) No code of conduct applies.

7. Warranty

Statutory warranty rights apply.

8. Retention of title

Ownership remains with us until full payment is received. In case of default, we may reclaim the goods. The buyer must notify us of third-party claims or seizures immediately.

9. Transport damage

(1) Please report visible transport damage immediately to the carrier and contact us.

(2) Failure to report does not affect your statutory rights but helps us with claims against carriers.

11. Copyright notice

All content on this website is protected by copyright. Unauthorized use is prohibited.

12. Severability clause

If any provision is invalid, the validity of the remaining provisions remains unaffected.
